Rochin v. California

In this assignment, examine and evaluate the situation involving Mr. Rochin, in the case of Rochin v. California, a U.S. Supreme Court case. Rochin v. California, 342 U.S. 165 (1952). Police broke into Rochins room without a warrant. The police asked about two capsules lying on a bedside table. Rochin put them in his mouth. After an unsuccessful struggle to extract the capsules by force, the officers took Rochin to a hospital by force, where more force was used to cause him to vomit against his will. He vomited two capsules, which were found to contain morphine. These were admitted in evidence at his trial, over his lawyers objection, and he was convicted in a California state court of violating a state law forbidding possession of morphine. He appealed to an intermediate appeals court in California and lost. Rochin lost again in the Supreme Court of California. In a paper of at least 3 pages, examine the U.S. Supreme Courts rationale for overturning his conviction and define the use of force as discussed in this case.
